Brazilian Court Rules in Favor of Uber Citing No Employment Relationship between Firm and Drivers

On Wednesday a federal judge in Brazil’s labor court Breno Medeiros, ruled in favor of Uber Technologies Inc. (UBER) against an Uber driver based in Sao Paulo citing absence of any employment relationship between Uber and the Uber drivers.

The federal judge claims he failed to identify any employer-employee relationship since the Uber drivers can disconnect from the app any time they feel like hence this granted them a flexible work schedule, one they are fully in charge of.

It’s from this perspective judge Breno said it’s was impossible to have an employer-employee relationship since the drivers are always widely flexible in their day to day work.

Nevertheless, the judge characterized the relationship between Uber and drivers as a partnership since the drivers pocket between 75 to 80% of the total payment in each ride.

Uber has always been of the opinion that it is an intermediary platform not an employer, a position it claims every driver accepts when they register with Uber.

Following this ruling, the ride hailing firm issued a statement fully supporting the position that it’s not an employer.

Brazil is the second largest market for Uber worldwide after the United States and its capital Sao Paulo records most number of Uber rides than any other city in the world.
